The Citizen as Founder: Public Participation in Constitutional Design
This paper examines various hypotheses regarding the effect of public participation (through ratification) on the constitution-making process and surveys available empirical evidence to determine the impact of ratification on legitimacy, conflict, and constitutional endurance. The paper also discusses the concept of participatory constitutional design in general and explores the variety of ways in which citizens can have input in the constitution-making process.
