Transitional Constitutional Measures
This document explores the use of transitional constitutional measures. It distinguishes between transitional measures in a Constitution that will be amended but which will largely serve as the permanent constitution, and those that provide a framework for creating an entirely new constitution. With respect to each of these types of transitional documents, the paper sets out who is usually responsible for drafting them and how the process is organized, in addition to the timelines of the processes, the underlying principles that apply to their drafting (if any), and the continuity of law that existed prior to them.
