Guarantee of Due Process

This option report compares constitutional provisions related to the guarantee of due process. The sample of constitutions reviewed consists of almost 600 constitutions enacted since 1789. The report compares the prevalence of explicit guarantees of due process, which consist of procedural safeguards required when depriving a person of his/her life, liberty or property. In addition, the report provides sample constitutional provisions related to the guarantee of due process the report does not look at constitutional provisions that provide other procedural safeguards that are not explicitly due process guarantees.
