Right to Asylum

This option report compares constitutional provisions related to the right to asylum. The sample of constitutions reviewed consists of almost 600 constitutions enacted since 1789. In addition to detailing the historical trends with respect to the right to asylum, the report provides sample constitutional provisions including those that frame the right in terms of the ability of the state to grant asylum, those that prohibit extradition of “political refugees," those that provide that the law will determine whether the right is provided for at all, and those that say that the right exists and details will be provided by law.
