Right to Pre-Trial Release

This option report compares constitutional provisions related to the right to pre-trial release with respect to criminal trials. The sample of constitutions reviewed consists of almost 600 constitutions enacted since 1789. In addition to detailing the trends with respect to this right, the report sets out sample constitutional provisions dealing with: the right to be released on bail, the prohibition of excessive bail, the denial of bail, the prohibition of denying bail without just cause, and the details left to non-constitutional law.
