Popular Authorship and Constitution Making: Comparing and Contrasting the DRC and Kenya

This articles compares the constitution-making processes in the Democratic Republic of Congo and Kenya (up to 2008). The author compares and contrasts questions of constitutional legitimacy, validity, and efficacy in the respective constitution-making processes. The author concludes that whereas in Kenya widespread participation and consultation resulted in voting down the constitution, in the DRC minimum participation did not affect its overwhelming approval.
